1. Introduction These Terms of Service ("Terms") govern the use of the services and products provided by Luma Health ("we," "us," "our") to you ("you," "your"). By accessing or using our services, you agree to comply with these Terms. If you do not agree with these Terms, you should not use our services.
2. Services Provided 2.1 LumaHealth offers non-invasive fertility support through treatments such as GigaLaser therapy. Our goal is to support your fertility journey with effective, safe, and convenient services designed to complement traditional fertility treatments.
2.2 All medical or health-related content is for informational purposes only and does not constitute medical advice. Always consult a qualified healthcare professional before beginning any treatment.
3. Eligibility You must be 18 years or older to use our services. By using our services, you confirm that you are of legal age and have the capacity to enter into a binding contract.
4. Booking and Payments
4.1 You agree to provide accurate information when booking sessions and making payments. Payments are due upon booking.
4.2. All fees are non-refundable except as expressly set out in our Refund & Reward Policy. Conception-based refunds apply only when pregnancy is confirmed in accordance with our published terms.
4.3 We reserve the right to change our pricing or promotional offers at any time; existing bookings remain subject to the terms in effect at the time of booking.
5. Refund Policy If you conceive before the next payment is due, you will not be charged for that payment. Refund amounts will be issued following confirmation of pregnancy and in accordance with the terms outlined in the promotional offer. We reserve the right to provide no fund when payments are in full and at the start of the therapy.
6. Cancelation
6.1 You may cancel or reschedule sessions up to 24 hours before the appointment without penalty.
6.2 Cancellations made less than 24 hours in advance, or no-shows, will be charged in full.
7. Client Responsibilities You agree to follow all instructions provided by our team and to inform us of any changes to your health or medical condition during the course of treatment. If you experience any adverse reactions or side effects, you should seek medical advice immediately.
8. Medical Disclaimer 8.1 While we aim to provide the best care, we do not guarantee the success of any treatment. The results of our therapies can vary, and we are not responsible for any outcomes, side effects, adverse reactions or complications that may arise.
8.2 LLLT is generally considered safe and non-invasive, but individual responses vary.
8.3 By using our Services, you acknowledge that no treatment guarantees success, and you assume all risks associated with the therapy.
8.5 You agree to disclose any relevant medical history or conditions and to follow all pre- and post-treatment instructions. Seek medical advice immediately if you experience adverse reactions.

10. Governing Law These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes will be resolved in the courts of Ireland.

Understanding of Therapy
I understand that Low Level Laser therapy is a non-invasive laser treatment designed to support fertility by improving blood circulation, reducing inflammation, and enhancing cellular health.
I understand that the Low Level Laser is not a guaranteed cure for infertility, and results may vary depending on individual circumstances.Medical Advice
I acknowledge that the Low Level Laser therapy is not intended to replace medical advice, diagnosis, or treatment provided by a licensed medical professional.
I confirm that I have consulted with, or will consult with, my physician or fertility specialist regarding this therapy and its suitability for my condition.Assumption of Risk
I understand that, although Low Level Laser therapy is generally safe and non-invasive, there may be risks or side effects, including but not limited to mild discomfort, temporary redness, or other unforeseen reactions.
I voluntarily assume all risks associated with this therapy.No Guaranteed Outcomes
I acknowledge that there are no guaranteed outcomes or results from this therapy, and success rates may depend on individual factors, including health, age, and underlying conditions.Consent to Treatment
I give my informed consent to undergo Low Level Laser fertility therapy. I confirm that I have had the opportunity to ask questions about the procedure and have received satisfactory answers.Release of Liability

Waiver
By selecting "Yes, I Agree," on the the patient intake form or Google sheet, I confirm that I have read, understood, and agree to the terms of this waiver agreement. I am participating in GigaLaser therapy of my own free will and accept full responsibility for the outcome.
Product Sales
1.1 These Terms of Service and Terms of Sale (“Terms”) govern the use of the website located at www.luma.ie (the “Website”) and all purchases of products supplied by Luma Heath Limited (“Luma”, “we”, “us”, “our”) in the Republic of Ireland and the United Kingdom.
1.2 By accessing the Website, placing an order, or purchasing Products from Luma, the Customer acknowledges that they have read, understood, and agreed to be bound by these Terms in full.
1.3 Luma Heath Limited is the authorised sole distributor and reseller of PowerMedic products within the territories of the Republic of Ireland and the United Kingdom pursuant to separate commercial arrangements with the Manufacturer, and no provision of these Terms, nor any sale conducted hereunder, shall operate to confer upon any Customer any right, title, interest, licence, authority, or entitlement in respect of those distribution rights, whether by implication, estoppel, course of dealing, reliance, or otherwise.
1.4 All rights relating to the manufacture, regulatory approval, design, conformity assessment, branding, intellectual property, and commercial exploitation of the Products remain exclusively vested in the Manufacturer.
2. APPLICATION OF TERMS
2.1 These Terms apply to all purchases of Products from Luma, including:
(a) Consumers acting outside the course of trade or profession; and
(b) Business Customers acting in the course of trade, profession, or commercial activity.
2.2 In the event of any conflict between these Terms and any purchase order, quotation, invoice, or other terms supplied by the Customer, these Terms shall prevail unless expressly agreed in writing by a director of Luma.
3. PRODUCTS AND REGULATORY STATUS
3.1 The Products include photobiomodulation systems, Class 3B laser devices, accessories, consumables, and related equipment.
3.2 Certain Products may constitute medical devices within the meaning of EU Regulation 2017/745 (Medical Device Regulation) and are CE-marked or otherwise certified as applicable.
3.3 Luma acts solely as an independent distributor and reseller and does not manufacture, design, modify, clinically validate, or provide independent warranties in respect of the Products.
3.4 All technical specifications, clinical data, regulatory certifications, conformity declarations, and safety documentation are issued by the Manufacturer and are provided for guidance only.
3.5 Luma does not provide medical advice, treatment guarantees, diagnostic services, or clinical recommendations.
3.6 Any claims regarding therapeutic outcomes, efficacy, or performance results published on the Website are provided by the Manufacturer and are not independently verified or endorsed by Luma.
4. LASER DEVICE SAFETY
4.1 Class 3B laser devices carry inherent risks if misused or operated contrary to Manufacturer instructions.
4.2 The Customer acknowledges and agrees that:
Proper training is required before using the Products;
All safety instructions, including use of protective eyewear, must be strictly followed;
Failure to comply with instructions may result in injury or damage;
Luma is not responsible for misuse, modification, integration into other systems, or operation outside Manufacturer guidance.
5. ORDERS AND CONTRACT FORMATION
5.1 All orders placed on the Website or otherwise are offers to purchase.
5.2 A binding contract arises only upon Luma issuing written confirmation of acceptance of the order.
5.3 Luma reserves the right to refuse, cancel, or limit any order in its absolute discretion, including but not limited to cases of pricing errors, stock shortages, or suspected misuse.
5.4 Any cancellation or refusal prior to dispatch shall not give rise to liability for Luma beyond the refund of sums already paid.
6. PRICE, PAYMENT AND TITLE
6.1 All prices are stated in Euro unless otherwise specified.
6.2 VAT is applied in accordance with Irish law.
6.3 Payment must be received in cleared funds prior to dispatch unless credit terms are expressly agreed in writing by a director of Luma.
6.4 Title in the Products remains with Luma until full payment has been received.
6.5 Risk passes:
For Business Customers: upon delivery to the delivery address or collection by the carrier;
For Consumers: upon physical possession of the Product.
7. RETURNS AND CANCELLATION
7.1 Consumers are entitled to statutory cancellation rights under Irish law (generally 14 days for distance contracts), subject to statutory exceptions, including but not limited to:
Sealed goods that have been opened after delivery and are unsuitable for return for reasons of health or hygiene;
Used medical or laser devices;
Customised or personalised goods.
7.2 Business Customers may not return Products unless defective, non-conforming, or explicitly agreed in writing by Luma. Restocking fees may apply.
8. MANUFACTURER WARRANTY
8.1 Products are supplied with the Manufacturer’s warranty only.
8.2 Luma makes no additional warranties beyond those required by law.
8.3 Warranty claims must follow Manufacturer procedures.
8.4 Luma’s role is limited to facilitating communication with the Manufacturer and providing reasonable administrative assistance.
9. COMMERCIAL STATUS
9.1 The relationship between Luma and the Customer is and shall at all times remain that of independent contracting parties dealing at arm’s length, and nothing in these Terms, any transaction, any course of dealing, correspondence, marketing, reliance, repeat ordering, volume purchasing, duration of supply, or other conduct shall be construed as creating, implying, evidencing, or giving rise to:
A partnership within the meaning of the Partnership Act 1890 or otherwise;
A joint venture;
A commercial agency under the European Communities (Commercial Agents) Regulations;
A fiduciary relationship;
A franchise arrangement;
A principal–agent relationship;
An employment or representative relationship;
Any distributor or sub-distributor appointment;
Any form of exclusivity or protected territorial right.
9.2 The Customer has no authority to:
Bind Luma contractually;
Enter into agreements on behalf of Luma;
Make representations or warranties in Luma’s name;
Incur liabilities on behalf of Luma;
Hold itself out as an “official partner,” “authorised distributor,” “exclusive provider,” or any similar designation.
9.3 Any unauthorised representation constitutes a material breach of these Terms.
9.4 Purchase of Products does not confer:
Distribution rights;
Territorial rights;
Sub-distribution rights;
Marketing or branding rights;
Marketplace or online listing rights;
Training or clinical certification rights;
Any form of exclusivity.
9.5 Exclusivity or special commercial rights shall arise only pursuant to a separate written agreement executed by a director of Luma.
9.6 This clause shall survive termination or cessation of any supply or commercial dealings.
10. LIMITATION OF LIABILITY
10.1 Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability which cannot lawfully be excluded under Irish law.
10.2 Subject to the foregoing, Luma shall not be liable for:
Indirect or consequential loss;
Loss of profits;
Loss of revenue;
Loss of business or opportunity;
Loss of data;
Reputational harm;
Dissatisfaction with clinical outcomes.
10.3 For Business Customers, Luma’s total aggregate liability shall not exceed the purchase price paid for the Product giving rise to the claim.
10.4 Luma shall not be liable for misuse, modification, negligent handling, or operation outside Manufacturer instructions.
11. INDEMNITY (BUSINESS CUSTOMERS)
Business Customers shall indemnify and hold harmless Luma from all claims, losses, liabilities, damages, costs, or expenses arising from:
Resale of Products;
Professional or clinical use;
Customer misuse or negligence;
Regulatory non-compliance caused by the Customer;
Misrepresentation of authority or status.
12. INTELLECTUAL PROPERTY
All trademarks, logos, Product names, branding, content, and materials remain the property of Luma or the respective rights holders.
No licence is granted except for lawful resale identification.
Unauthorised use is strictly prohibited.
13. DATA PROTECTION
Personal data is processed in accordance with GDPR and Luma’s Privacy Policy.
14. FORCE MAJEURE
Luma shall not be liable for delays, failures, or non-performance caused by events beyond reasonable control, including but not limited to: acts of God, war, terrorism, strikes, supply chain disruption, or regulatory delays.
15. SEVERABILITY
If any provision is held invalid or unenforceable, the remainder of these Terms shall remain in full force and effect.
16. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of Ireland.
The courts of Ireland shall have exclusive jurisdiction.
